(hereinafter referred to as “Augusta Abogados”), makes certain informative content about its activities available on its website www.augustaabogados.com<\/a> (hereinafter referred to as the “Website”). This is in compliance with Act 34 of 11 July 2002 on information society and electronic commerce services (hereinafter referred to by its initials in Spanish “LSSI”).<\/p>

Augusta Abogados is a company that was incorporated on 3 November 2008, with registered office at Via Augusta 252, 4\u00ba A – 08017 Barcelona, Spain, assigned Tax Identification Code (CIF) B-64943988 and recorded in the Companies Registry of Barcelona in volume 40825, folio 18, sheet B-376.355, registration 1.<\/p>

These general terms and conditions govern solely and exclusively the use of the Augusta Abogados website by the users who access it (hereinafter referred to as the “User” or the “Users”). Aspects concerning the processing of Users’ personal data related to the use of the Website are regulated in the Website’s Privacy Policy.<\/p>

By accessing and using the Website, the User accepts in its entirety, declares to understand and undertakes to fully comply with these general terms and conditions, the Privacy Policy and any instructions or recommendations that may be provided in each specific case.<\/p>

The Users acknowledge and accept that the use of the Website is at their sole risk and responsibility at all times, and therefore Augusta Abogados shall not be held liable for any misuse or improper use that may be made of the Website.<\/p>

Augusta Abogados shall only be held liable for damages that the User may suffer as a result of the Use of the Website for the purposes of current legislation.<\/p>

4.1. AUGUSTA ABOGADOS shall not be held liable whatsover for the following:<\/p>

4.1.1. The content of the webpages and websites linked through the links included in the Website;<\/p>

4.1.2. Damages of any kind caused to the User’s computer equipment by viruses, worms, Trojans or any other harmful element.<\/p>

4.1.3. Damages of any kind caused to the User resulting from failures or disconnections in telecommunications networks that cause the Website service to be suspended, cancelled or interrupted.<\/p>

4.1.4. Any type of damage that Users or third parties may cause to the Website;<\/p>

4.1.5. The conditions or characteristics of the articles offered on the Website.<\/p>

4.2. Augusta Abogados reserves the right to suspend access without prior notice on a discretionary basis and on a definitive or temporary basis until effective liability for any damages that may occur is ensured.<\/p>

4.3. AUGUSTA ABOGADOS shall only be held liable for the provision of the services offered within the limits and as specified in the different proposals of professional services accepted by the clients.<\/p>

FIVE: INTELLECTUAL PROPERTY COPYRIGHT AND TRADE MARK RIGHTS<\/h5>

The intellectual property rights over the layout of the contents of the Website (including the sui generis right over the database), its graphic design (look & feel), distinctive signs such as trade marks and trade names, the underlying computer programs (software), including source codes, as well as all the elements that make up the Website (including photographs, videos, texts, graphics, images, etc.), are owned by Augusta Abogados or Augusta Abogados holds the right to use and exploit them, as the case may be.<\/p>

In this respect, these elements constitute works protected by current legislation on intellectual and industrial property. “Augusta Abogados” is a registered trade mark, owned by Augusta Abogados, S.L.P.<\/p>

The use of the “Augusta Abogados” trade mark, which includes both the name and the logo, by any means by third parties is prohibited, except with the express consent of Augusta Abogados.<\/p>

The use of the Website by the user does not imply in any way the transfer of any right over the intellectual and industrial property of the Website, its contents and any distinctive signs of Augusta Abogados.<\/p>

In this respect, except in those cases in which it is legally permitted, any reproduction, transformation, distribution, public disclosure, making available, extraction and reuse of the aforementioned protected elements is expressly prohibited without the express consent of Augusta Abogados.<\/p>

SIX: JURISDICTION AND APPLICABLE LAW<\/h5>

These general terms and conditions are governed by Spanish law. Any disputes or claims arising from these general terms and conditions shall be submitted to the jurisdiction of the Courts of Barcelona.<\/p>

In the event that any clause of this document is declared null and void, the other clauses shall remain in force and shall be construed taking into account the will of the parties and the purpose of these terms and conditions.<\/p>

Augusta Abogados may choose not to exercise any of the rights and authorization conferred in this document, which shall not, under any circumstances whatsover, be construed as a waiver of such rights unless expressly acknowledged by Augusta Abogados.<\/p>
