Since its publication, it has been the subject of controversy, as it established the obligation to register in the Unmanned Aircraft Registry of the Ministry of the Interior all those drones with an MTOM of 250 g or more, as well as drones equipped with sensors capable of capturing personal data, regardless of their MTOM. It also established the obligation to register in said Registry all transfers of ownership over UAS, from their initial commercialization until the end of their useful life, whether due to disappearance, loss, theft, total destruction, condition of definitive uselessness, etc.<\/p>\n<p>Alarmed by the military uses that were being given to drones of an initially civilian nature, the Ministry of the Interior insisted on having mechanisms &#8220;<em>in order to prevent, investigate or detect the commission of criminal and administrative offenses, including protection and prevention against threats to public security<\/em>.&#8221;<\/p>\n<p>However, the Supreme Court considers that the public information procedure was not respected when introducing these provisions in the draft Royal Decree. The Supreme Court indicates that &#8221; <em>the creation of such a Registry was introduced after the phase of allegations and public information. And it is certainly a substantial novelty, not without controversy as we have seen, about which nothing has been alleged in these proceedings and which implies registration obligations whose infringement, moreover, has a specific sanctioning provision [&#8230;]. A novelty of such relevance, with the controversy that precedes it, is, as we say, &#8220;substantial&#8221;, so it had to be submitted to a new procedure of public information and hearing, especially when there was time to do so without delaying the approval of the royal decree.&#8221; <\/em>.\u201d<\/p>\n<p>We attach a copy of the judgment and we will have to see how the Government reacts to reintroduce the now repealed regulations.
