Decree-Law 9\/2025, of 29 july, extending the leave for birth and care of a child has been published"},"content":{"rendered":"<p>Royal Decree-Law 9\/2025, of 29 July, has been published in the Official State Gazette dated 30 July 2025, extending birth and child care leave, by amending various labour and social security regulations, as well as the Basic Statute of Public Employees, to extend birth leave,\u00a0 adoption, foster care and foster care with the aim of completing the transposition of Directive (EU) 2019\/1158,<\/p>\n<p>In the field of employment, this Royal Decree-Law modifies article 48.4 and 5 of the Workers&#8217; Statute, increasing, in general, the duration of the leave for birth and care, adoption, guardianship for the purpose of adoption and foster care by three weeks, going from 16 to 19 weeks for each parent, being able to be divided into 6 mandatory and uninterrupted weeks after childbirth (full time).\u00a0 11 voluntary weeks until the child is 12 months old and 2 additional weeks for parental care until the child is 8 years old.<\/p>\n<p>This duration is 32 weeks in the case of single-parent families, with 6 being compulsory, 22 voluntary and 4 for parental care.<\/p>\n<p>In both cases, the weeks following the mandatory ones, which can be enjoyed full-time or part-time, with prior agreement with the company, with at least 15 days&#8217; notice, continue to be considered as an individual right of the worker and, therefore, non-transferable.<\/p>\n<p>In the event that both parents work in the same company, the company may limit the simultaneous enjoyment for justified reasons and this right is expressly recognised for pregnant trans people.<\/p>\n<p>In addition, it guarantees that these three additional weeks will be paid, maintaining the receipt of the worker&#8217;s ordinary income.<\/p>\n<p>In terms of Social Security, Articles 181 and 182 of the General Social Security Law are amended.<\/p>\n<p>As for the requirements of the beneficiaries of the birth and child care benefit, it is expressly regulated that they must be registered or in a situation assimilated to registration at the beginning of each rest period and access to the subsidy is allowed without complying with the minimum contribution period.<\/p>\n<p>Finally, the regulation relating to the extension of leave for birth and care of a child will apply to the causal events from 2 August 2024, and will therefore be retroactive.<\/p>\n<p>The effective enjoyment of these additional weeks and the corresponding financial benefit may be
