¿Requirement for UK citizens to provide a guarantee for litigation?

Recent decisions issued by courts in EU Member States are considering requiring claimants from the UK (but also from other states outside the EU) to provide security for costs and expenses that may be incurred in litigation they initiate in a Member State, if they do not have assets in that State. Specifically, various decisions issued by German and Austrian Courts show us the possibility that cautio iudicatum solvi will gradually be reintroduced in some European legal systems in the post-Brexit period. This note analyses these recent decisions and presents a possible scenario for the application of this guarantee in Spain.
