Nuestros servicios en el Departamento Laboral están orientados al asesoramiento integral a la empresa en las cuestiones y aspectos jurídico-laborales y de Seguridad Social que surgen tanto en su actividad habitual como en las operaciones especiales en las que se ven involucradas.
Cuando resulta necesario, asesoramos en los procesos de reestructuración que precisan nuestros clientes, aportando nuestra experiencia tanto en procesos de negociación colectiva con los agentes sociales y con la administración laboral, como en procesos concursales seguidos en la instancia judicial.
Tenemos una amplia experiencia en los siguientes ámbitos:
- Redacción de contratos de alta dirección y de directivos de rango medio;
- Elaboración y/o revisión de planes de incentivos, retribuciones variables, planes “stock-options” y/o “long-term incentives”, compromisos por pensiones y planes de compensación flexible;
- Tramitación y negociación de despidos individuales objetivos y Expedientes de Regulación de Empleo y asesoramiento general en procesos de reestructuración;
- Expedientes de suspensión temporal de empleo;
- Despidos disciplinarios y otras sanciones;
- Asistencia en procedimientos de modificación sustancial de condiciones de trabajo por movilidad geográfica;
- Asistencia y defensa legal del cliente ante reclamaciones judiciales y administrativas en el orden social y contencioso-administrativo laboral;
- Asistencia y defensa del cliente en todo tipo de actuaciones ante la Inspección de Trabajo;
- Elaboración y negociación de convenios colectivos, acuerdos de empresa y reglamentos de política interna («Códigos de Conducta»);
- Asesoramiento integral (i.e. laboral, extranjería, fiscal y Seguridad Social) en procesos de expatriación («Expatriates Desk»);
- Asesoramiento general sobre obligaciones y responsabilidades en materia de Prevención de Riesgos Laborales y asistencia en procesos de accidentes de trabajo graves o muy graves
- Asesoramiento en materia de cotizaciones, bonificaciones e incentivos a la contratación, encuadramiento de socios y administradores; y
- Asesoramiento en la elaboración, negociación e implantación de Planes de Igualdad.
