The new Act 5/2018 regarding the illegal property occupation enter into force, today 2nd of July

Act 5/2018, which modifies some provisions of Act 1/2000 of Civil Procedure, foresees the processing of lawsuits aiming to protect those individuals who have been deprived of their possessions’ use (things or rights), and the possibility of asking for the immediate recover of the property’s full or partial possession. Such processing, which will be carried out in an oral hearing, will enable those plaintiffs who intend to recover the possession of a property to aim their lawsuit against the unknown occupants of the latter. Furthermore the lawsuit will have to include the title deed to the plaintiff’s right of possession. Finally, having the property’s clearance resolution been notified, the Act foresees the social services’ intervention to protect those occupants who may need housing, therefore achieving both the judicial resolution’s execution and the prevention of residential exclusion situations.
